Terms and Conditions

Effective date: March 15th, 2023

By ordering GANSK products, every client agrees with the following Terms and Conditions:

1- PRICING AND ORDER

  • 1.1

    The values on GANSK price list are for the public and substitute any other published or advertised before;

  • 1.2

    Pro-forma orders will require a 40% deposit upon the order and the remaining payment prior to shipping from the company;

  • 1.3

    Customized pro-forma orders will require 50% initial deposit. The remaining must be paid until 3 days before the dispatch date;

  • 1.4

    All pieces are property of GANSK until the payment is fully received;

  • 1.5

    GANSK reserves the right to defer the dispatch date until the payment is fully received;

  • 1.6

    GANSK prices always refer to one unit and are ExWorks Barcelos, Portugal;

  • 1.7

    VAT is not included, therefore this legal tax must be added to the price;

  • 1.8

    GANSK prices don’t include shipping costs or fees;

  • 1.9

    The packaging is included in the price, however, if a specific package is required by the client, its cost will be charged accordingly;

2- LEAD TIMES

  • 2.1

    The minimum production time is between 7 to 8 weeks, starting from the day the order is placed and confirmed, with delivery time not included;

  • 2.2

    For custom pieces or large quantities orders, GANSK reserves the right to agree with the client the date of delivery. The agreed date may change due to production restrictions;

3- FREIGHT POLICY AND DAMAGE CLAIMS

  • 3.1

    Shipping companies are client’s choice. If the client chooses to transport the products on his own, GANSK will be free from any liability regarding the shipping; 

  • 3.2

    If the shipping is requested to GANSK, it will be charged apart from the product’s value;

  • 3.3

    GANSK is not liable for damages during shipping;

  • 3.4

    The order is owned by the client from the moment the goods are picked up by the carrier in the company;

  • 3.5

    All products are carefully packed and inspected prior to shipment. Refusing a damaged order does not relieve the buyer of responsibility for its payment;

  • 3.6

    Any visible damage in the packaging (wooden crate or other) must be immediately reported to the carrier with the intent to make a written claim. The written proof of claim and photographic evidence of the damaged packaging must be reported to GANSK within 48 hours of delivery by email, to This email address is being protected from spambots. You need JavaScript enabled to view it.. Any visible damage that occurred on the ordered pieces, must also be reported to GANSK with photographic evidence;

  • 3.7

    After delivery the client has 15 days to carefully unpack, assemble and test all ordered pieces. Any damage or non-conformity item must be reported to GANSK with photographic evidence. Not reporting visible or non-visible damages within 15 days after delivery, results on its denial;

  • 3.8

    The order should be carefully unpacked, and the package kept intact for 15 days after receipt. Should any issue occur during this period, the damaged item should be carefully repacked and sent to GANSK facilities for inspection as client’s expense;

  • 3.9

    If the package is discarded or damaged and cannot be re-used, the client is responsible for the proper repack of the goods and ensure their delivery well protected;

4- RETURNS AND ORDER CANCELLATION

  • 4.1

    No returns will be accepted without a written consent from GANSK. Unauthorized returns will be refused as client’s expense;

  • 4.2

    Cancellations after 5 working days from the order being placed, may result in a restocking cost as client’s expense;

5- PRODUCTION AND DISTRIBUTION POLICIES

  • 5.1

    GANSK reserves the right not to sell, or continue to sell, to any distributor whose sale policies have a negative impact on our reputation for competing or selling to a region or city;

  • 5.2

    Many of GANSK finishes or textures are hand-made, therefore, they may vary in color, tone or character. While GANSK will make every effort to match a finish, slight variations may occur;

  • 5.3

    GANSK reserves the right, for pieces produced totally or partially with materials of natural origin (e.g. Marble, Wooden Veneer, etc.), to adjust their prices, delivery dates and/or suggest a similar material, if after consultation with the supplier there are stock ruptures, discontinuity of the material or significant changes in prices;

  • 5.4

    The images/photographs of GANSK products produced totally or partially with materials of natural origin (e.g. Marble, Wooden Veneer, etc.), serve only as an example, not being possible to guarantee the same colors, shapes and patterns in all orders where the same references are considered, due to the unique characteristics, intrinsic to the nature of these materials;

6- LIABILITY

  • 6.1

    GANSK shall not be liable for any lost profits or savings, loss of reputation or goodwill, indirect or incidental or consequential damages arising out or in connection with the sale of the goods;

7- AMENDMENTS AND UPDATE

  • 7.1

    The Terms and Conditions of GANSK may be amended from time to time due to new laws and regulations or other reasons. The new Terms and Conditions shall be effective as of the date of publication on gansk.pt and shall therefore apply to orders submitted after that date;
